Background. In comparison with other pioneer federative states – USA and Canada – the Australian Federalism has been formed rather late. The process itself developed slowly without mass enthusiasm and under pressure of external factors and the desire of London to diminish defense expenditures.
Matherials and methods. The author applied historical data, decisions of the Australian High Court to demonstrate peculiarities and dynamics of the Australian Federalism.
Results. It is claimed that the Australian Constitution combines the US style federalism with the British parliamentary system. There are 40 joint subjects of powers for the federative center and the Australian states, but subjects of powers for the states are not specifically defined. State Constitutions and the Federal Constitution do not contain special bills of rights. In the process of a quite revolution in favor of centralization two main instruments were used: financial aid to the states from the federal budget and decisions of the High Court.
Conclusions. The former dominion, which has strengthened its independence owing to the Act of British Parliament (1986) and the Act of Australian Parliament (1985), has a rather stable federal system. But there is some kind of public disappointment with the desire of Australian conservative pro-business forces to use centralization against the interests of the working people. Simultaneously, the Australian federalism has a sound legal foundation because of its democratic traditions. Also its law is more unified than the law of other countries with legal precedents.
